How do I accept the terms of the EULA?

You accept the terms of the EULA by:

1. Executing, submitting, or accepting an Order (including any free trial) either electronically or in writing.

2. Installing, accessing, or using a Capstone Digital Product or any related documentation.

3. By signing and accepting the terms of the EULA.

Who is eligible to use Capstone Digital Products?

The products are available for purchase by individuals who are 18 years of age or older. If you access the products from outside the United States, you are responsible for compliance with local laws and regulations.

What user types can purchase a license for Capstone Digital Products?

Parent/Legal Guardian: For use by a child under 18 years of age, with verifiable parental consent.

Educator: Teachers or school administrators authorized by their school or district.

School/District: Administrators purchasing for use by schools or districts.

General Adult: Individuals over 18 years of age for personal use.

Organization: Legal entities purchasing products to their customers or end users.

What is required for account creation and credentialing?

All users must register and create an account to access and use Capstone Digital Products. The information provided must be correct, current, and complete. Educators and Schools/Districts may designate administrative users (Admin Users) who can create additional authorized user accounts.

What security measures are in place for user accounts?

Users are responsible for maintaining the security and confidentiality of their login credentials. Immediate notification to Capstone is required if any unauthorized access or disclosure occurs. Capstone reserves the right to disable any compromised account credentials.

What should I know about uploading User Content?

Permissions: Only upload content you have the right to use.

Standards: Content must comply with all applicable laws and must not be defamatory, obscene, or otherwise objectionable.

Representation: You represent that you own or control all rights to the content you upload.

How does Capstone handle children’s information and student information?

Capstone processes children’s information in accordance with its Privacy Policies. For student information, including Education Records under FERPA, you must comply with all applicable laws and obtain necessary consents and permissions.

What are the terms for data retention and backups?

Capstone retains student information only as necessary to fulfill obligations under the agreement and may destroy data no longer needed. Users are responsible for maintaining backups of their account data.

How can I use the Capstone Digital Products?

Users are granted a limited, non-exclusive, non-transferable license to access and use the products for your internal, non-commercial use. Organizations may provide access to their customers or end users but cannot use the products for personal profit or to compete with Capstone.

What should I do if I believe my copyright has been infringed?

Follow the instructions in Capstone’s Copyright Policy to request the removal of infringing materials.

How are AI features in Capstone products managed?

Capstone may use artificial intelligence in systems to provide products or features. These components are "as is" without any express or implied warranties.

How do I access and use the product content?

Capstone provides access to content at its discretion and may modify or remove content without notice. Users are not entitled to refunds or replacements for removed or modified content.

What are the terms for subscription and renewal?

Subscriptions can be monthly or annual and are non-refundable. Automatic renewals may occur unless canceled before the current term ends. Free trials expire after the trial period, and continued use requires valid payment information. All other subscriptions will be bound by the specific terms of the Order.

What are the limitations of Capstone's liability?

Capstone disclaims all warranties and limits liability for any damages arising from the use or inability to use the products. This includes unauthorized access or loss of data.
