Acceptable Use Policy

This Acceptable Use Policy governs your access to and use of the Capstone Digital Products, together with our websites and related mobile applications. Capstone reserves the right to amend, alter, or modify this policy at any time.

By accessing or using any of the Capstone Digital Products, you accept and agree to be bound and abide by this policy. If you do not want to agree to this policy, you must not access or use the Capstone Digital Products. You also consent to Capstone’s collection, use, and disclosure of your information in accordance with the Capstone Privacy Policies (located at https://www.capstonepub.com/support/privacy-central).

When accessing or using the Capstone Digital Products or any of our websites or related mobile applications (the “Services”), you shall not:

• Use the Services in a way that violates applicable law, including:

  • Illegal activity such as child pornography; gambling; piracy; violating copyright, trademark or other intellectual property laws.
  • Uploading and distributing unlicensed licensed software.
  • Threatening, stalking, defaming, defrauding, degrading, victimizing or intimidating anyone, including Capstone or its personnel, for any reason. o Invading anyone's privacy by attempting to harvest, collect, store, or publish private or personally identifiable information, such as passwords, account information, credit card numbers, addresses, or other contact information without their knowledge and consent.

• Use the Services in a way that could harm the Services or impair anyone else's use of the Services, including:

  • Any attempt to gain unauthorized access to the Services (such as by using a password made available on the Internet, without any accompanying purchase by you of a license to use the Capstone Digital Products), acting to deny others access to the Services, or authorizing any third party to access or use the Services on your behalf (such as anyone without a license or revealing to anyone your username and password).
  • Use the Services to try to gain unauthorized access to any other service, data, account or network by any means.
  • Use any automated process or service to access or use the Services such as a BOT, a spider or periodic caching of information stored by Capstone or its service providers. o Intending to harm or exploit minors in any way.
  • Transmitting content that harms or disrupts, or intends to harm or disrupt, another user's device or would allow you or others to illegally access software or bypass security on devices, websites, or servers, including but not limited to spamming.

• Falsify any email information or in any way misrepresent your identity, including misrepresenting the source of anything you post or upload or impersonating another individual or entity, such as with "spoofing."

• Use the Services to transmit, distribute, or deliver any unsolicited bulk or unsolicited commercial e-mail (i.e., spam). • Remove, modify, or tamper with any regulatory or legal notice or link that is incorporated into the Services.

Additionally:

• Capstone is not responsible for the content of any user-created posting or message. The decision to view content or engage with others is your decision alone. We advise you to use your best judgment.

• You are responsible for protecting your device against interference, spyware, or viruses.

• When accessing a Trial Account, you are strictly prohibited from adding any and all personal information to the account, including but not limited to student personal information.

• You are strictly prohibited from sharing your account credentials with any other person or impersonating any person or misrepresenting your identity or affiliation with any person or organization in accessing or using the Services.

• Capstone reserves the right to monitor your use of the Services and take any action we deem necessary or appropriate in our sole discretion if we believe a user's conduct violates this policy, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Services or the public, or could create liability for Capstone. We may disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy. We may also take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Services.
